What Germantify Offers

Germantify is an educational platform designed to help users learn and understand German grammar through interactive analysis. Our Service includes:

• Sentence Analyzer: A public tool that analyzes German sentences and provides detailed grammatical breakdowns of each word
• Text Reader: An authenticated feature that allows users to upload and read German texts with word-by-word interactive grammar explanations

Educational Purpose

Germantify is intended solely for educational and language learning purposes. It is not a professional translation service, language certification program, or authoritative grammar reference. The analyses and explanations provided should be used as learning aids, not as definitive grammatical authorities.

Account Registration

To access certain features (such as the Text Reader), you must create an account by providing a valid email address and creating a password. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate and current
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Account Security

You are solely responsible for safeguarding your password and any activities or actions under your account. We recommend using a strong, unique password and enabling any available security features. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.

Our Intellectual Property

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Germantify name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You must not use such marks without our prior written permission.

Your Content and License to Us

You retain all rights to any text, documents, or other content you submit, upload, or otherwise provide through the Service ("Your Content"). However, by submitting Your Content to Germantify, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display Your Content solely for the purpose of providing and improving the Service.

This license exists only for the duration necessary to provide you with the requested service and to improve our platform. We do not claim ownership of Your Content.

Limited License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial educational purposes. This license does not include any right to:

• Resell or make commercial use of the Service or its contents
• Collect and use any product listings, descriptions, or prices
• Make derivative uses of the Service or its contents
• Download or copy account information for the benefit of another party
• Use any data mining, robots, or similar data gathering or extraction methods

"As Is" Service

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• The quality of any products, services, information, or other material obtained through the Service will meet your expectations
• Any errors in the Service will be corrected

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Diogo Neves Marques, nor any of our affiliates, directors, employees, agents, or service providers, be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Reliance on any AI-generated grammatical analysis or explanation
• Any errors, mistakes, or inaccuracies in the content or analyses provided

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

Indemnification

You agree to indemnify, defend, and hold harmless Diogo Neves Marques and our affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

Termination by You

You may terminate your account at any time by following the account deletion process available in your account settings. Upon termination, your right to use the Service will immediately cease.

Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms or our Acceptable Use Policy
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security issues
• Requests by law enforcement or other government agencies

Effect of Termination

Upon termination of your account, your right to access and use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

Governing Law

These Terms and any disputes arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

Jurisdiction and Venue

You agree that any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the competent courts of Bern, Switzerland, and you irrevocably consent to the personal jurisdiction and venue of such courts.

Dispute Resolution

Before filing any formal legal action, we encourage you to contact us directly to seek an informal resolution of any dispute. We are committed to working with you to reach a fair resolution.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the Service.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the extent necessary to make it valid and enforceable.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice or consent. Any assignment attempted to be made in violation of these Terms shall be void.

Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, labor disputes, or failures of internet service providers or hosting facilities.
